If brothers decide to give property to their sister, then a question arises in people's minds whether the sister's husband will also have rights over it. Know what the legal rules say about property.
In India, laws have been made for every work. Rules have also been laid down under the law regarding the division of property. Often when property is divided in the family, sometimes such decisions are also taken which surprise people. Many times people think that if a property is transferred in someone's name, then does any other person related to it also have rights over that property.
For example, if brothers transfer the property in the name of their sister, then will the sister have complete control over the property transferred to her name or will her husband also have some role in it? Many people do not have clear information about this. What does the law say in such a case? Let us tell you.
Does the husband have a right in the property gifted by the brothers?
If all the brothers gift property to their sister, then the ownership right is completely with the sister. According to the law, after the gift deed, the property is considered to be of the one in whose name the gift has been made. In such a case, the husband has no direct right over it. If later the sister wants to sell or transfer that property, then also she does not need the consent of the husband in the legal documents. But if the sister dies and she has not made a will, then in that case the husband can claim his share as the legal heir of that property.
What is a gift deed?
A gift deed is a legal paper through which a person gives his property, land or house to someone else without taking any money. In this, the giver is called the donor and the receiver is called the donee. But this document is considered legal only when it is made on stamp paper and registered in the registry office. After doing this, the entire right over the property goes to the person in whose name it has been gifted. Overall, the gift deed is proof that now the real owner of the property is the person to whom it has been given.
